Chapter 13 Final Step; Confirmation Hearing
Confirmation Hearing
What happens AT the Confirmation Hearing:
You will usually NOT have to come to the Confirmation Hearing. This hearing is scheduled about 2 months after your petition filing date.
At the hearing, Isabel Balboa reviews the entire case to:
1. Determine if you have supplied all of the requested information that was asked for by her at the meeting.
2. Determine if any creditors have objected to your plan.
3. Determine if any creditors have filed claims in a larger amount or in a different amount than we had filed in our plan. This means they claim you owe them more or less money.
4. Determine if you have made every single payment to the trustee, on a timely basis.
5. Calculate the correct amount of monthly payments to be made in the future in the event it is necessary to change your monthly payments under the plan.
6. Determine whether you have the financial ability to make the required payments.
7. Determine if a wage order is appropriate.
Based on the information above, Ms.Balboa will determine the monthly payments that you will be required to pay. Payments can normally be made over any period between 36 months and 60 months. Once we have a definite figure for your payments as determined at the confirmation hearing, you are required to make monthly payments to Ms.Balboa in that amount until your plan payments have been completed.
What happens AFTER the Confirmation Hearing:
You are required to make regular monthly payments to Ms.Balboa.
If for some reason you cannot make your payment to Ms.Balboa on time, please let us know immediately. There are procedures which can give you the opportunity to temporarily suspend payments and get additional time to make your required payments.
If you make car and mortgage payments, you are required to make regular monthly car and mortgage payments, unless your car is being paid through the plan.
If you cannot make your monthly car or mortgage payment, please tell us immediately. There are procedures which can give you the opportunity to suspend these payments.
We want to make sure that you succeed. If for some reason you fall behind in your payments, and you receive an APPLICATION TO DISMISS letter from Ms.Balboa, YOU MUST NOTIFY US IMMEDIATELY, or your case can get dismissed in 5 days. If your case is dismissed you will have no protection from your creditors. So the best thing to do is to make all of your payments on time, or to call us immediately if you think that you cannot make any of your payments on time.
