Can I File Bankruptcy More than Once?

Some people think they can only file for bankruptcy one time. Many of my blogs get pretty lengthy, and they are sometimes a little complicated.

I could make this blog long and complicated also, but I think it's best to make it short and simple.

There are rules that might limit and restrict the number of times a person can successfully file for bankruptcy, but the bottom line is that, yes, you can file for bankruptcy more than just once,

Here's a quick example. Let's say you got all of your bills wiped out in a successful chapter 7 just two years ago. Now you've fallen upon hard times once again, and your home is in danger of being sold at a sheriff's sale. Do you think that it's fair that you shouldn't be able to file for bankruptcy again and legally stop that sheriff's sale so that you have an opportunity to save your home?

The answer here is that even though you wiped out your bills in that chapter 7, you can now once again file a bankruptcy and stop that sheriff's sale and save your home.

I could give you many examples where people are permitted to file bankrupcy more than once, but as I said, I think it's best to keep it simple.

If you are facing a difficult financial challenge, and you have previously filed for bankruptcy, don't automatically think that you can't do it again. I have had clients over the years that have filed bankruptcy five or six times. If you understand how the bankruptcy laws work, you can use those laws to your advantage when you need to do so.

A number of years ago I had a client who had filed a previous successful bankruptcy with my office, and she told me that she had filed a second bankruptcy with another attorney. I knew we had done a good job for her, and I asked her why did she hire a different attorney the second time around? She told me that she felt embarassed and ashamed that she had to file another bankruptcy. I told her that she should never feel embarrassed or ashamed in a situation such as this. Life happens. challenges happen, and we can't control all of our circumstances.

If you are presently facing financial challenges, please don't feel embarrassed or ashamed. It's certainly not your fault that we are in the midst of a pandemic, and other weird and crazy things may be happening.
